Temuan Dokumen Baru

Dalam perjalanan waktu, ketika ada begitu banyak yang membaca ulasan-ulasan saya edisi 1-5, mereka memberikan berbagai dokumen baru berkaitan dengan tanah yang disengketakan saat ini. Dokumen-dokumen itu membenarkan bahwa “ada teka-teki” dalam banyak aspek terkait tanah Toroh Lemma Batu Kallo.

Di penghujung tahun 2015, muncul Surat dari BPN Labuan Bajo bertanggal 21 Desember 2015. Surat itu berisi tentang undangan Sidang Panitia “A” Permohonan Hak Atas Tanah atas nama Dai Kayus. Surat ditujukan kepada Lurah Labuan Bajo, Anggota Panitia “A”, Muhamad Naser, Abdul Gani, Umar Ali, Maling Pembalas masing-masing sebagai Ahli Waris, Ente Puasa dan Muhamad Syair selaku saksi. Diundang juga H. Umar Ishaka dan Ramang N. Ishaka selaku Fungsionaris Adat, termasuk Dayus Kayus selaku pemohon. Dalam dokumen surat itu masih ditambahkan juga nama-nama yang diundang antara lain: Fatimah Badosalam, Muhamad Ali, Baharudin Kamis, Masan Basri, Samsul Bahri dan Sarul Rol. Total yang diundang adalah 17 orang.

Adapun Panitia “A” masuk dalam dokumen Peraturan Kepala Badan Pertanahan Nasional Republik Indonesia Nomor 7 Tahun 2007. Dalam pasal 1 dijelaskan bahwa Panitia Pemeriksaan Tanah A yang selanjutnya disebut Panitia “A” adalah panitia yang bertugas melaksanakan pemeriksaan, penelitian dan pengkajian data fisik maupun data yuridis baik di lapangan maupun di kantor dalam rangka penyelesaian permohonan pemberian hak milik, hak guna bangunan, hak pakai atas tanah Negara, hak pengelolaan dan permohonan pengakuan ha katas tanah.

Oleh Kejati NTT, Dai Kayus juga menjadi salah satu tersangka dan sudah ditahan. Apa yang menarik dari kasus Dai Kayus ada dalam tiga aspek ini. Pertama, alas hak kepemilikan tanah dari Dai Kayus dibenarkan oleh Funsionaris Adat Kedaluan Nggorang yang diwakili oleh H. Umar Ishaka dan Ramang N. Ishaka. Setelah kepemilikannya menjadi jelas, termasuk juga akta notaris dengan status kepemilikan yang tetap maka Day Kayus melakukan pensertifikatan hingga sertifikatnya keluar. Sertfikat keluar dari BPN dan dengan demikian menjadi final bahwa tanah itu miliknya.

Kedua, Kejati telah menangkap Dai Kayus serta kepala BPN dengan tuduhan karena mengambil tanah Negara sehingga menyebabkan kerugian Negara 3 triliun (belakangan nilai kerugian diturunkan Kejati menjadi 1,3 triliun). Juga Notaris yang melakukan proses akta tanah, Theresia Koro Demu ditahan. Sedangkan H. Umar Ishaka dan Ramang N. Ishaka, sebagai pihak yang memberikan keterangan mengenai alas hak atas tanah, belum ditangkap dan dijadikan tersangka. Peran mereka sangatlah penting. Sebagai Fungsionaris Adat, mereka bukan saja memiliki pengetahuan tentang tanah tetapi juga kuasa atasnya. Karena itu, jika mereka menyatakan bahwa tanah itu bebas dan merestui untuk pembuatan sertifikat, bukankah mereka juga bagian yang harus bertanggungjawab? Jika temuan Kejati tidak sealur dengan fakta ini, apa alasannya? Ataukah Kejati tebang pilih? Hal itu diperjelas pada point ketiga.

Ketiga, ada begitu banyak nama lain yang yang ada dalam dokumen Undangan BPN terkait Sidang Panitia “A” Permohonan Hak Atas Tanah Dai Kayus sebagaimana sudah dijelaskan di atas, ada 4 orang ahli waris dan 2 orang saksi, mengapa mereka juga tidak masuk sebagai tersangka? Kedudukan mereka sebagai ahli waris dan saksi atas tanah sangatlah penting. Saksi atas tanah, misalnya saksi batas, menjadi pemilik lahan di lokasi yang sama. Artinya, dua orang yang menjadi saksi juga memiliki lahan di daerah sengketa itu. Demikian halnya dengan para ahli waris, adalah pihak yang menerima tanah warisan dari orangtuanya.
