Kasus Tanah Pemda di Labuan Bajo

Sementara publik ingin mengetahui bagaimana kelanjutan perkara kasus tanah yang dinyatakan sebagai milik Pemda oleh Kejati NTT, Ketua Tim Penyidik, Roy Riyadi dimutasi ke Palembang. Menurut informasi Kejati, perpindahan itu adalah promosi jabatan karena telah berhasil mengungkap kasus yang merugikan Negara. Agak mencengangkan juga frase yang dipilih “berhasil” sementara penanganan kasus tanah di Toro Lemma Batu Kallo masih on process (sedang berlangsung). Publik bertanya-tanya, ada apa sebenarnya? Apakah Kejati NTT telah “salah kaprah dan terlalu dini” menetapkan status tersangka kepada para pelaku?

Sidang Praperadilan kasus Tanah Labuan Bajo memasuki babak baru. Sidang ini berjalan dalam dinamika untuk menemukan kebenaran dan tentu akhirnya keadilan. Para saksi dimintai keterangan. Ada perluasan materi dan ikutannya menjangkau orang-orang baru untuk menjadi saksi.

Dalam sidang praperadilan Kamis, 11 Februari 2021, ada situasi yang mengejutkan. Dua orang saksi, ZD dan FH dinilai Kejati telah memberikan keterangan palsu dalam persidangan. Betapa tidak, dalam sesi sidang itu, ZD dan FH bersaksi bahwa tanah Toro Lemma Batu Kallo bukanlah tanah Pemda (Negara) melainkan tanah masyarakat. Menurut Kejati, dua saksi itu telah memberikan keterangan palsu karena berbeda pernyataan mereka saat memberikan pendapat dalam pemeriksaan di Labuan Bajo dalam penyidikan Kejati (HU Pos Kupang edisi Sabtu 13 Februari 2021).

Tentu saksi ZD dan FH memberikan keterangan di pengadilan di bawah sumpah. Dari sisi ini, dimensi legalitas, pendapat sebagai saksi lebih tinggi di Pengadilan dibandingkan pemeriksaan tim penyidik Kejati NTT. Karena menemukan adanya perbedaan antara keterangan dengan penyidik dan di Pengadilan, kedua saksi itu kemudian ditangkap dan dijadikan tersangka. Selain itu, kuasa hukum Bupati Manggarai Barat, Antonius Ali, S.H, M.H., juga dipanggil untuk diperiksa pada Senin, 15 Februari 2021. Tak sampai di situ saja, orang-orang lain, termasuk istri Bupati Manggarai Barat juga diperiksa (Pos Kupang 16 Februari 2021). Pertanyaan kunci Kejati NTT adalah “Siapa aktor yang menyebabkan mereka memberikan keterangan berbeda dari temuan Kejati?” (HU Pos Kupang edisi 15 Februari 2021).
